Klimatime Group General terms and Conditions

1. Scope

1.1 Business Model and Offerings: Klimatime Group operates as an online retailer specializing in climate products, heat pumps, and associated services, including a smart control system for monitoring and control of heat pumps. All transactions and interactions with Klimatime Group are facilitated through our online platform hosted on Shopify. We do not operate any physical stores.

1.2 Target Audience: Our platform is designed for consumers (B2C) without any age restrictions. While we primarily cater to individual consumers, businesses seeking our products and services are also welcome.

1.3 Geographical Operation: Klimatime Group offers its products and services exclusively within the European Union. Users outside of this geographical scope will not be able to finalize transactions or avail of our services.

1.4 Platform Accessibility: Our platform is accessible across various devices, including desktops, mobiles, and tablets. We currently do not offer any mobile applications.

1.5 User Accounts: While users can browse and make purchases without creating an account, we offer the option for users to register an account for a more personalized experience and to track their orders and service requests.

1.6 Content and Intellectual Property: Our platform may feature testimonials from our customers. All content, including the name "KLIMATIME," is trademarked within the EU and is the exclusive property of Klimatime Group. Unauthorized use or reproduction of our content and trademark is strictly prohibited.

1.7 Updates and Modifications: Klimatime Group reserves the right to frequently update the platform, including adding new products, adjusting prices, and modifying information. We also retain the flexibility to update these Terms of Service at our discretion without direct notification to users. Users are encouraged to review our Terms of Service periodically to stay informed.

2. Contractual Partner, Conclusion of Contract

2.1 The contract is concluded with Klimatime Group AB, registration number: 559432-6752, VAT number: SE55943267501, located at c/o Arkipelagens Företagscenter, Järnvågsgatan 3, 413 27 Göteborg. 2.2 When products or services are listed on our website, they represent an invitation to customers to make an offer. They are not a binding offer on our part.

2.3 After a customer has placed an order, we send an order confirmation to the provided email address. This order confirmation is not binding. 

2.4 If customers wish to correct their details or change their order before it's dispatched, they should contact us via email at info@klimatime.com. In the email, the customer should include their order number, email address, and phone number used during the order and specify the changes they wish to make.

2.5 Cancellations of orders are accepted 14 days from that you receive the order. To cancel an order, please contact us via email at info@klimatime.com.

3. Contract Language, Storage of Contract Text

3.1 Languages for Contract Conclusion: The available languages for contract conclusion on our platform are English, German, Dutch, Swedish, and French. It's essential to ensure that you understand the terms and conditions, and we recommend choosing a language you're most comfortable with when making a transaction.

3.2 Storage of Contract Text: We store the text of your contract and order data for a minimum of 5 years. This is to ensure compliance with regulatory requirements and to serve you better in case of any discrepancies or issues.

3.3 Accessing Past Orders: Customers can access details of their past orders by sending a request to info@klimatime.com. Please provide relevant contact information used during the order to help us retrieve your details promptly.

3.4 Contract Delivery: After the successful conclusion of a contract, we will send you the contract details, including the terms and conditions, via email. We do not provide physical copies, and we recommend keeping the digital copy safe for your records.

4. Terms of Delivery

4.1 Delivery Times

  • Delivery times is stated on the product page for each product. It is the time it takes from making an order until it is delivered to the address of choice. It is valid for all the countries we ship to within EU. 

4.2 Shipping Costs and Conditions: The specific prices and conditions for shipping are provided at the checkout when you select your shipping option. All shipping prices for specific countries and regions are fixed and will be displayed on our website depending on the product.

4.3 Tracking and Delivery Coordination: Once your order is shipped, you will have access to tracking information. Customers will have the opportunity to decide on a suitable delivery time. Additionally, to ensure smooth delivery, our delivery personnel will call you 15-30 minutes before the delivery.

4.4 Delivery Areas:  Many of our products have a delivery time with the suppliers and the times that stand for each product on the product pages are the estimated time from the order being placed until the order is delivered. It thus includes delivery time at the supplier, picking and packing as well as delivery to your chosen address. If you want a more precise delivery timeframe, we recommend reaching out to Klimatime Group AB via info@klimatime.com or our customer service via phone or chat. If delivery is not possible for any reason, we will inform you as soon as possible.

4.5 Out-of-Stock Products: In the event a product is out of stock after an order is placed, we will promptly inform the customer and provide an estimated delivery timeframe. We will also offer a similar alternative product for the customer to choose from.

4.6 Heavy Products: All products weighing over 30 kg will be delivered on a pallet to the property boundary. It is the customer's responsibility to inspect the products upon delivery to ensure they have received the correct items and that the condition of the products is acceptable.

5. Payment Methods and Terms

5.1 Available Payment Options: We offer a variety of payment methods to cater to our customers' preferences:

  • Klarna and Klarna Pay Later: This option allows you to receive your order first and pay for it later. Pay within 30 days of receiving your order or split the purchase on monthly bases.
  • Credit Card: We accept major credit cards, including Mastercard and Visa.
  • Bank Transfer: Directly transfer the payment amount to our bank account.
  • PayPal: Secure online payments through your PayPal account.

5.2 No Additional Fees: We do not charge any additional fees or charges based on the payment method you choose.

5.3 Refunds: If you are eligible for a refund, please note that the processing time can take up to 14 days, depending on the payment method used for the initial transaction.

5.4 Refund Denials: We reserve the right to deny a refund in the following circumstances:

  • If we have delivered the products and they are not returned to us.
  • If a purchase is made outside the bounds of legality.
  • If we suspect any suspicious activity related to the transaction.

6. Warranties and Guarantees

6.1 Product-Specific Warranties: The warranty details for each product are specified on their respective product pages. It's essential to refer to these pages for specific warranty terms.

6.2 EU-Wide Guarantee: As per Directive (EU) 2019/771, all products sold within the EU, Norway, or Iceland come with a minimum 2-year guarantee at no additional cost. This guarantee covers consumers against products that are faulty or not as described.

6.3 Extended Warranties: We may offer extended warranties for our products in the future. Details will be provided closer to the launch of this service.

6.4 Warranty Coverage: Our warranties primarily cover manufacturing defects. Any issues arising from regular wear and tear or misuse are not covered.

6.5 Warranty Claims: If you believe your product has a defect covered by our warranty, please fill out the warranty claim form on our website. We will review your claim and get back to you promptly.

6.6 Warranty Exclusions: The warranty may be voided in the following circumstances:

  • If the product has been mishandled or used carelessly.
  • If the defect or damage was caused by incorrect installation. In such cases, the installer is responsible for rectifying the issue.

7. Returns and Refunds

7.1 Return Window

  • You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, have taken possession of the last goods.

    7.2 Return Conditions:

    • The product should be returned in a condition that allows for a proper assessment of its functionality and features, similar to what would be possible in a physical store.
    • Original packaging is preferred but not mandatory, provided the product is adequately protected during return shipping.
    • All original accessories and documentation should be included in the return.

    7.3 Right of Withdrawal:

    • To exercise your right of withdrawal, you must inform Klimatime Group AB, Järnvågsvägen 3, 41327 Gothenburg, Sweden, by telephone +46101992597 or email address: info@klimatime.com, by a clear statement (e.g., a letter sent by post, or an email) of your decision to withdraw from this contract.
    • You may use the attached model withdrawal form, but it is not obligatory.
    • If withdrawal can be made online, you can also electronically fill out and submit the model withdrawal form or another unequivocal statement on our website here Withdrawal Form. We will promptly acknowledge receipt of such withdrawal (e.g., by email).
    • To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

    7.4 Return Method:

    • Returns should be made via post.

    7.5 Return Shipping Costs:

    • Return shipping costs are the responsibility of the customer in cases of buyer's remorse. We recommend using a trackable shipping service or purchasing shipping insurance.
    • For defective items, Klimatime Group offers free returns with no additional fee.

    7.6 Free Returns for Defective Items:

    • For defective items, Klimatime Group will provide a return label for hassle-free return.
    • Ensure the item is properly packaged before sending it back to us using the provided return label.

    7.7 Refunds:

    • Once your return is received and inspected, we will notify you about the approval or rejection of your refund.
    • If approved, your refund will be processed to your original payment method within a specified number of days.

    7.8 Restocking Fee:

    • No restocking fee will be charged for any returns.

    7.9 Non-returnable Items:

    • Currently, all our products are eligible for return, provided they meet the above conditions.

      8. Liabilities and Disclaimers

      8.1 Installation Responsibility: Klimatime Group AB is not responsible for any installation errors that may arise. Customers are obligated to hire a certified refrigeration technician for the installation of products governed by the F-gas regulation. Klimatime Group AB does not assume any responsibility for installations.

      8.2 Right to Cancel Purchase: We reserve the right to cancel any purchase at our discretion.

      8.3 Product Liability: Klimatime Group AB disclaims all liability for consequences resulting from product defects that may lead to personal injury or property damage.

      8.4 Accuracy of Information: While we strive to provide accurate product information, we reserve the right to correct any inaccuracies or omissions on our website. Klimatime Group AB is not responsible for any inaccuracies in product catalogs, manuals, or brochures provided by manufacturers.

      9. Intellectual Property

      9.1 Ownership: All content, including but not limited to, the logo, graphics, images, text, and software, is the property of Klimatime Group AB and is protected by international copyright laws. The company name "KLIMATIME" is a registered trademark protected under EU trademark laws.

      9.2 Unauthorized Use: Any unauthorized use, reproduction, modification, distribution, or performance of the content on this website is strictly prohibited without express written consent from Klimatime Group AB. Violation of this clause may result in legal action.

      9.3 Reporting Infringements: If you believe that any content on our website infringes upon your intellectual property rights or other proprietary rights, please contact us immediately at info@klimatime.com with detailed information about the alleged infringement.

      10. Intellectual Property and Dispute Resolution

      10.1 Intellectual Property Rights

      • All content on the Klimatime Group AB website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Klimatime Group AB or its content suppliers and is protected by international copyright laws. The compilation of all content on this site is the exclusive property of Klimatime Group AB and is protected by international copyright laws.
      • The trademark "KLIMATIME" is a registered trademark within the EU and is the exclusive property of Klimatime Group AB. Unauthorized use of this trademark is strictly prohibited and may result in legal action.

      10.2 Governing Law

      • These terms and conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the European Union.

      10.3 Dispute Resolution

      • In the event of any dispute arising out of or in connection with these terms and conditions, the parties shall first attempt to resolve the dispute through the European Commission Online Dispute Resolution (ODR) platform.
      • If the dispute cannot be resolved through the ODR platform, the parties agree to submit the dispute to arbitration. The arbitration will be conducted in English, in Gothenburg, Sweden, in accordance with the rules of the Arbitration Institute of the Stockholm Chamber of Commerce.
      • If the dispute cannot be resolved through arbitration, the parties agree to submit the dispute to the competent courts of Gothenburg, Sweden.

      10.4 Modifications to Terms of Service

      • Klimatime Group AB reserves the right to modify, amend, or change these terms and conditions at any time without prior notice. It is the responsibility of the user to regularly check these terms and conditions for updates. Continued use of the website after any changes constitutes acceptance of the new terms and conditions.

      11. Compliance with Fluorinated Greenhouse Gas Regulations

      11.1 Legal Obligations for Pre-filled Equipment

      Pre-filled refrigeration, air-conditioning, and heat pump equipment, or equipment which is not hermetically sealed and which is filled with fluorinated greenhouse gases as defined in Regulation (EU) 517/2014, may only be sold to the end-user where evidence is provided that the installation will be carried out by an undertaking approved in accordance with the relevant regulations.

      11.2 Dealer Responsibilities

      The dealer of the device must inform the buyer of this legal obligation and may provide a list of qualified companies or electronic registers or existing databases that collect qualified companies. The reseller shall also deliver to the purchaser the necessary documentation as stipulated in the relevant regulations.

      11.3 Purchaser Responsibilities

      The purchaser of the equipment must, within a maximum period of one year, send the reseller a copy of the document accrediting the installation by an approved company with personnel certified for this installation. The purchaser shall retain their copy of the necessary documentation for a period of five years.

      11.4 Reporting Obligations

      From 1 January 2018, the trader shall inform the competent body of the autonomous community concerned, on an annual basis, of the buyers who have not sent the required document, attaching a copy of the necessary documentation. The seller shall retain the required documents for a period of five years for potential inspections.

      11.5 Sanctions

      Non-compliance with the obligations established in this section on the part of both the purchaser and the seller of these devices will be subject to the sanctioning regime provided for in the relevant laws and regulations.

      11.6 Additional Provisions

      The provisions of the European Union (Fluorinated Greenhouse Gas) Regulations 2016 shall apply where relevant.
